Det kan handla om l\u00e4gsta l\u00f6n, upps\u00e4gning, f\u00f6rs\u00e4kringar eller vad som ska f\u00f6rhandlas. En del av reglerna i lagen om anst\u00e4llningsskydd \u00e4r dispositiva och dessa kan parterna komma \u00f6verens om i ett kollektivavtal. Kollektivavtalet blir arbetsgivare bundna av genom att bli medlem i en arbetsgivarorganisation som tar betalt av dig genom en viss procent av din l\u00f6nekostnader. Men det g\u00e5r \u00e4ven att bli bunden genom att ing\u00e5 avtalet direkt med ett fackf\u00f6rbund. Arbetsgivaren kan teckna avtalet direkt med fackf\u00f6rbundet. D\u00e5 kallas det f\u00f6r h\u00e4ngavtal. Avtalet \"h\u00e4ngs\" p\u00e5. Juridiskt \u00e4r det inga skillnader. Undantag g\u00e4ller f\u00f6r dem som har monopol, s\u00e5som Systembolaget, de m\u00e5ste faktiskt s\u00e4lja sina produkter och p\u00e5 det viset ing\u00e5 k\u00f6peavtal med enskilda. Ingen ska beh\u00f6va tvingas in i ett avtal. <\/span><\/p><p><span style=\"font-weight: 400;\">Enligt Medlingsinstitutet \u00e4r 90% av all personal i Sverige dock bundna av kollektivavtal. Det kr\u00e4vs att man faktiskt l\u00e4ser avtalet i sin helhet f\u00f6r att ta reda p\u00e5 detta. N\u00e4r du \u00e4r bunden av ett kollektivavtal s\u00e5 m\u00e5ste du f\u00f6lja det. Annars \u00e4r risken att du f\u00e5r betala skadest\u00e5nd till fackf\u00f6rbundet f\u00f6r kollektivavtalsbrott. <\/span><\/p><p><span style=\"font-weight: 400;\">Nedan \u00e4r ett exempel p\u00e5 n\u00e5gra av klausulerna i Hotell och restaurangbranschens h\u00e4ngavtal inneh\u00e5ller:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Allm\u00e4nna anst\u00e4llningsvillkor som anst\u00e4llningsformer och upps\u00e4gning<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Arbetstider<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">L\u00f6ner<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Semester<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ordningsregler<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Personalbost\u00e4der<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">F\u00f6rs\u00e4kringar<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Arbetsledning<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Upps\u00e4gning<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Hur dokument ska se ut s\u00e5som anst\u00e4llningsavtal, l\u00f6nespec och arbetstidsschema<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Anlitande av bemanningsf\u00f6retag<\/span><\/li><\/ul>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3866cd7 wd-width-100 elementor-widget elementor-widget-wd_title\" data-id=\"3866cd7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"wd_title.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"title-wrapper wd-set-mb reset-last-child wd-title-color-primary wd-title-style-underlined wd-title-size-small text-left\">\n\n\t\t\t\n\t\t\t<div class=\"liner-continer\">\n\t\t\t\t<h2 class=\"woodmart-title-container title wd-fontsize-m\">F\u00f6rdelar f\u00f6r en arbetsgivare att vara bunden av kollektivavtal?<\/h2> \n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-32f1ebe elementor-widget elementor-widget-wd_text_block\" data-id=\"32f1ebe\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"wd_text_block.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"wd-text-block reset-last-child text-left\">\n\t\t\t\n\t\t\t<p><span style=\"font-weight: 400;\">Det finns klara f\u00f6rdelar med att vara bunden av ett kollektivavtal som arbetsgivare.\u00a0<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Att vara bunden av kollektivavtal g\u00f6r det ocks\u00e5 smidigare i kontakten med Arbetsf\u00f6rmedlingen om du vill uppb\u00e4ra st\u00f6d f\u00f6r viss arbetskraft.\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Vid deltagande i offentliga upphandlingar st\u00e4lls det ofta krav p\u00e5 att arbetsgivaren ska kunna visa p\u00e5 att de har villkor i paritet med kollektivavtal. Det \u00e4r inget krav att ha kollektivavtal. Men du ska d\u00e5 kunna visa p\u00e5 att du har lika bra villkor som en arbetsgivare som \u00e4r bunden av kollektivavtal.\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Du faller in i f\u00f6rdomen om att du \u00e4r en \u201cseri\u00f6s\u201d arbetsgivare och beh\u00f6ver inte f\u00f6rklara dig<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fredsplikt r\u00e5der under tiden du har kollektivavtal. Det inneb\u00e4r att din personal inte f\u00e5r strejka eller ta till andra strids\u00e5tg\u00e4rder<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00c4r du bunden av kollektivavtal s\u00e5 finns det viss m\u00f6jlighet att om fackf\u00f6rbundet s\u00e5 vill ing\u00e5 individuella lokala regler som ska g\u00e4lla p\u00e5 din arbetsplats utan att komma \u00f6verens om det med alla anst\u00e4llda.
