Det som \u00e4r viktigt att ha i \u00e5tanke som chef och arbetsgivarrepresentant \u00e4r diskrimineringslagen och de diskrimineringsgrunder som finns. Att inte f\u00e5 ett arbete som en arbetstagare s\u00f6ker p\u00e5 grund av n\u00e5gon av dessa grunder \u00e4r diskriminering och \u00e4r skadest\u00e5ndsgrundande. Diskriminering delas upp i:<\/span><\/p><ol><li><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">Direkt diskriminering<\/span><\/span><\/li><\/ol><p><span style=\"font-weight: 400;\">Detta \u00e4r det typiska. Exempelvis att du fr\u00e5gar den arbetss\u00f6kande om denne avser vara f\u00f6r\u00e4ldraledig under arbetet varp\u00e5 du sedan meddelar att denne inte f\u00e5r arbetet p\u00e5 grund av just detta. Det finns ett direkt missgynnande mellan faktumet att denne inte fick arbetet och grunden f\u00f6r det som \u00e4r en diskrimineringsgrund.<\/span><\/p><p><span style=\"font-weight: 400;\">2. <\/span><span style=\"text-decoration: underline;\"><span style=\"font-weight: 400;\">Indirekt diskriminering<\/span><\/span><\/p><p><span style=\"font-weight: 400;\">Exempel p\u00e5 indirekt diskriminering \u00e4r n\u00e4r ett kriterium f\u00f6r en tj\u00e4nst st\u00e4lls upp som vid en f\u00f6rsta anblick verkar vara neutral men som indirekt missgynnar n\u00e5gon p\u00e5 grund av en diskrimineringsgrund d\u00e4r kriteriet igentligen inte beh\u00f6vs. Att st\u00e4lla upp krav p\u00e5 god svenska f\u00f6r en tj\u00e4nst som professor i svensk litteratur kan man f\u00f6rst\u00e5 men att st\u00e4lla upp samma krav p\u00e5 en st\u00e4dartj\u00e4nst kan komma att diskriminera dem med en annan etnisk tillh\u00f6righet \u00e4n svensk.<\/span><\/p>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-afa528f wd-width-100 elementor-widget elementor-widget-wd_title\" data-id=\"afa528f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"wd_title.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"title-wrapper wd-set-mb reset-last-child wd-title-color-primary wd-title-style-underlined wd-title-size-small text-left\">\n\n\t\t\t\n\t\t\t<div class=\"liner-continer\">\n\t\t\t\t<h2 class=\"woodmart-title-container title wd-fontsize-m\">Alla former av rekrytering omfattas och m\u00e5ste inte vara initierat av arbetsgivaren<\/h2> \n\t\t\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5b8786a elementor-widget elementor-widget-wd_text_block\" data-id=\"5b8786a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"wd_text_block.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"wd-text-block reset-last-child text-left\">\n\t\t\t\n\t\t\t<p>Det \u00e4r arbetss\u00f6kande som skyddas enligt diskrimineringslagen. Det inneb\u00e4r att skyddet aktiveras b\u00e5de vid spontanans\u00f6kningar s\u00e5som vid utannonserade tj\u00e4nster. Skyddet \u00e4r aktivt under alla kontakter med arbetsgivaren och alla aktiviteter som arbetsgivaren f\u00f6retar kopplat till den arbetss\u00f6kande som kan inneb\u00e4ra att den missgynnas. Exempelvis underl\u00e5tenhet att kalla en viss person till intervju.
